Motion: That we the members be informed as to the number of houses or apartments that have been offered to Kerry County Council by NAMA. Did we apply or ask for any over the last two years and how many have been accepted.
Reply: The Housing Agency was charged with responsibility for managing the examination of the NAMA and other distressed property portfolios to assess suitability for Social Housing proposals. The Housing Agency advised Kerry County Council of a total of 43 properties which might be suitable. The Council assesses all properties which are offered for consideration. A further 10 (one lot) have recently been offered so a total of 53 properties have been offered since 2015. Of the 43 assessed to date, the vast majority have been found to be unsuitable for Social Housing purposes. An additional 10 properties are currently being assessed. In relation to reasons for deeming properties unsuitable, the main reasons are: •Compliance with building regulations – including required certification •Property is structurally incomplete or unsound •Title issues, rights of way issues or other legal problems •Lack of demand in some areas can be a factor – some properties can be in very isolated or remote areas In addition to the established process through the Housing Agency, Council Management have requested a further meeting with NAMA to explore any opportunities their portfolio might have.

Motion: That Kerry County Council would underground the overhead cables at Rathmore as they are very unsightly upon entering Rathmore Village.
Reply: An assessment of Rathmore Village is currently being carried out by the NRDO in regard to a Traffic Calming Scheme for the village. When complete, the Feasibility Report will be sent to TII for their consideration. We will ask the NRDO to consider the undergrounding of overhead cables as part of this assessment.

Motion: When funerals take place in Barraduff Village, that some safety measures would be implemented in an effort to protect the public as they are forced to queue on the main road and this is highly dangerous.
Reply: The Funeral Home in Barraduff village is on the N72 National Secondary Route, which is the responsibility of the TII. An assessment is currently being undertaken by the NRDO for Barraduff. The NRDO will explore possible safety measures at this location as part of their assessment.

Motion: That Kerry County Council would take over Killarney Country Club (Faha Court, Faha). Please provide update as to why it is not taken over by now.
Reply: No taking in charge application has been received/submitted for this development. However, should an application be submitted it will not be taken in charge as this is a Holiday Home Development and in accordance with our Taking in Charge Policy, which was adopted in June 2008, Holiday Home Developments are not taken in charge by Kerry County Council.

Motion: That a full-time Litter Warden be employed in the Killarney Municipal District Area, to address the big litter problem and dog fouling in the area.
Reply: Kerry County Council takes the issues of litter pollution and dog fouling very seriously. The new Litter Management Plan which is before you today for adoption prioritises both these areas. We currently have three full time Litter Wardens and in addition to this our Traffic Wardens also have responsibilities for enforcing breaches of the litter legislation in towns. In addition to this we have two Waste Enforcement Officers who investigate serious issues of illegal dumping. All complaints are investigated in a timely matter and pursued where sufficient evidence is available to do so. Kerry County Council is recruiting an additional Traffic Warden for the 2017 season. Litter enforcement duties will form part of their brief.

Motion: That we write to the appropriate Minister asking why there is a delay in sending Auctioneers to value local authority housing for those who are lucky enough to be in a position to purchase their houses?
Reply: The Housing Department has been actively progressing the Tenant Purchase applications received in an effort to identify how many would eventually qualify for the scheme. There are several stages of the application process before a request for a valuation is issued. Housing are now in the process of seeking tenders for this Valuation Panel and it is hoped that this process and to have a panel of Valuers in place by mid April 2017. The Department has recently opened a public consultation process on the operation of the Scheme. Members were advised of this by the Director of Service and Members can make individual submission or can contact the Director of Service to have their views / comments included in a central submission.

Reply: All replies received from external Bodies arising from Notices of Motion raised at Killarney Municipal District Meetings are emailed directly to the proposer of the Notion of Motion. The replies are then circulated to all of the Municipal District Members when the Agenda for each Municipal District Meeting is issued.

Motion: That Kerry County Council would examine the type of tarmacadum being used on our roads. Is the proper mixture of bitumen being used. How often is it tested by our Engineers and can the results of tests be supplied.
Reply: Bituminous materials (Tarmacadam) for road surfacing are manufactured to comply with the TII specification for roadworks. Regular sampling is ongoing on all the national overlays and most of the non -nationals. Samples are tested by both the manufacturer and also by Kerry County Council’s in-house Laboratory. Results are available if requested. Skid tests are also undertaken prior to opening a new tarmac surface to traffic. It is important to note that bituminous materials are manufactured to withstand the stresses associated with normal traffic conditions. The aggregates used in tarmac are checked so that the properties meet the requirements for different traffic categories i.e., crushing values, skid properties etc.

Motion: That Kerry County Council immediately repair the foundations of the monument to “Patrick” in Rathmore as it is in grave danger of falling.
Reply: This monument in Rathmore is the responsibility of the National Graves Association and they recently had the condition of the monument assessed, the only issue arising from the assessment was the possibility that it would be struck by vehicles that were parking on the street. Kerry County Council have recently erected bollards around the monument to prevent it from being struck by vehicles.

Motion: That we, Kerry County Council, carry out immediate resurfacing works at the ‘Corner of the Park’, Park Hill, Killarney.
Reply: €60,000 has been allocated under the Roads Restoration Improvement Programme for 2017 for resurfacing 600m of the L-2033 roadway, Coolcorcoran to Park Cross. Works will be carried in Q3.

Motion: That we, Kerry County Council, would start a programme to put crash barriers in place from Rathmore to Shrone Cross as this area is very dangerous at present.
Reply: The TII are waiting for consultants to complete a HD17 (Safety) Report for the N72 National Secondary Route. This report would cover the stretch of roadway from Rathmore to Shrone Cross. Further to the completion and review of this report, the TII will decide what sections of the route requires safety barrier.

Motion: That an update be given on the Lewis Road Junction onto the Killarney By-Pass. We have a duty to try to save lives and we cannot continue to accept nothing being done at this junction.
Reply: We have raised the concerns of the Members in relation to the Lewis Road Junction with the TII on a number of occasions. The Junction with the Killarney By-Pass is part of the N22 National Primary Road Network. Any improvement works, including the revision of the road layout, is subject to the approval of and provision of funding from Transport Infrastructure Ireland (TII). The TII directly determines the locations that will be funded, based on criteria that are set down in their technical standards, and which are ranked having regard to recorded collision data. Whilst the location was not included on the list of schemes approved for design in the current year, we had further discussion with the TII, particularly having regard to the recorded minor injury accidents at this location over the past 5 years. We will shortly be making a formal submission to have this junction assessed.

Reply: That Development Contribution balances as at June 2014 in the Town Council accounts are ringfenced for the area of the Town Council as previously advised.

Motion: That an update be given on the current situation regarding the bicycle track at Glenflesk. The public need to be kept informed.
Reply: The project was to develop a downhill mountain bike trail to a specification capable of hosting future international championships up to the standard of those organised, promoted and governed by the Union Cycliste Internationale, the Association of National Cycling Federations. The project was initiated by Cycling Ireland in conjunction with the landowner. In order to assist and maximise the grant potential available, KCC facilitated the grant application process and funding of €430,353 for the project was sought from and approved by Fáilte Ireland. During the implementation process of the project, it became clear that there were a number of difficulties with the grant application, including meeting the requirements of EU Rules of Public Procurement. The operational guarantee which was required as part of the terms and conditions of the grant presented further difficulties for Kerry County Council. It was also regrettable that the project lost the involvement of the national cycling body. Every effort has been made to identify a solution which would resolve the issues raised. However, it is with great regret that having explored all the options, Kerry County Council and Fáilte Ireland are unable to proceed with the grant for the reasons outlined above.

Motion: That Kerry County Council would give a planning update on both the Rural Settlement Policy which is coming down the track but has not as yet been implemented. I am completely opposed to windfarms that are granted planning permission near dwelling houses.
Reply: Current planning policy in respect of rural housing is contained in Chapter 3 Settlement Strategy of Kerry County Council Development Plan 2015 – 2021, which was adopted unanimously at Full Council on the 16th of February 2015. Chapter 3 was prepared having regard to the Ministerial guidelines issued under Section 28 of the Planning and Development Acts 2000 – 2016, Sustainable Rural Housing, Guidelines For Planning Authorities. A working group has been established by the Department of Housing, Planning Community and Local Government, comprising of representatives from the Department and the Local Government Management Agency Land Use and Transport Service committee to examine a recent European Courts of Justice ruling, and to ascertain, if any, the implications on planning policy nationally. The Department has advised that the National Planning Framework, which is at an advanced stage of formulation, will assist any revision, if necessary, of the Ministerial guidelines. The Department has also advised in a Circular Letter dated the 31st of May 2017 that until the NPF and the report of the working group is complete, Local Authorities are should defer amending their rural housing policy / local need criteria presently contained in the County Development Plan.

Motion: That the workforce in the Killarney Municipal District Area, outdoor, be increased immediately. A number of part time outdoor positions have been made available but this is not enough and we will not maintain or increase our Tidy Towns marks if additional staff are not employed. We should not be supporting another Municipal Area with the money that is coming out of our area.
Reply: There are a number of factors that impact on the recruitment of staff within the current manpower planning activities of the Council which are continuously reviewed in the context of ensuring the delivery and prioritisation of key services and meeting our strategic priority objectives. Recent years has seen significant reductions across all funding sources which has resulted in a reduction in services being provided in these areas with a resulting impact on staff numbers. Therefore, the capacity of both internal and external funding sources remains a major consideration in reviewing staffing levels in all areas across the organisation and the Council continuously reviews staffing requirements and assigns additional resources as appropriate within these financial constraints.

Motion: That we would build a Columbarium Wall in Old Aghadoe to facilitate cremations as this is urgently needed.
Reply: It is intended to bring a discussion document to the September meeting of the Operations SPC in relation to the operations, management and provision of burial facilities in the County. The provision of a Columbarium wall will be considered in that context.

Motion: That we would open the right-of-way from Muckross View onto Muckross Road.
Reply: This pedestrian way from Muckross View onto Muckross Road was closed as there is a dangerous wall on the adjacent private property that bounds the laneway. This walkway is not in the ownership of Kerry County Council and is a private matter.

Reply: The old section of Aghadoe Cemetery is full and has no available graveyard spaces.

Motion: That we Kerry County Council would write to the appropriate authority regarding the use of unauthorised drones. The drones are frightening animals and are being used to monitor private homes. This is an unacceptable practice. The use of drones should be strictly licensed.

Motion: That Kerry County Council agree to deploy the Fire Service to all emergencies as there has been undue delays with the Ambulance Services attending the scene of either emergencies or road traffic accidents over the past two years.
Reply: The Fire Service in Kerry currently is deployed to every emergency , including medical emergencies, to which it is called. Matters of interagency policy (matters of common interest to the Fire Service and/or the National Ambulance Service and/or An Garda Siochána) are normally raised at national level through the National Directorate for Fire and Emergency Management for the Fire Service.

Motion: That we, Killarney Municipal District Council, would look at providing a skate park in Killarney and Castleisland, in consultation with the youth, as a group of teens approached me.
Reply: There is currently no funding stream available for the development of a skate park. If at any point in the future capital grants become available the Council could examine such a proposal.

The Council remains supportive of the provision of additional tourism infrastructure in the county.

Motion: That we, Killarney Municipal District Council, would write to the relevant Minister regarding the Purchase Scheme. Family members should be allowed to assist in purchasing a house for a family member, who is a tenant, in certain cases. Common sense must prevail.
Reply: The Tenant (Incremental) Purchase Scheme 2016 is the current scheme in operation that allows local authority tenants purchase their homes. It is a national scheme with the eligibility criteria defined by the Department. Any changes to the scheme would need to be initiated on a national basis.

Motion: That a full investigation be carried out by our Municipal District Manager regarding the circumstances surrounding the injury of a lady at the Ha Ha (Jarvey Stand) on Thursday afternoon, 6th July 2017 and how this lady arrived in the Jarvey Stand.
Reply: The Local Authority will review the incident in the context of the drop-off area at the Ha Ha and as this is an individual case, Kerry County Council cannot comment further at this time.

Motion: That the option to pay car parking charges by Credit/Debit Card would be considered for all public car parks in Kerry.
Reply: In response to a previous motion moved, the Council is undertaking a full review of payment options for parking throughout the County. This will include an assessment of payment options introduced in recent times by some other local authorities, including the option of cashless payment systems. This review will be completed by the end of the year and a report will be brought to Council on any capital investment that may be required to implement such a system.

Motion: That we Killarney Municipal District would urgently upgrade the public lighting in Ballyspillane Estate, commencing with the back rows where at present there is no public lighting.
Reply: Currently Kerry County Council operate and maintain 71 No. public lights within Ballyspillane and Hazelwood Drive. As part of our routine maintenance, as any lanterns are damaged or are beyond economical repair, we then change them out for an LED lantern. We have inspected the location and cannot identify the specific area, further details might be provided. As outlined in the Public Lighting Policy, any requests for public lights to be provided and operated by Kerry County Council will be assessed annually having regard to the available resources and the policy.

Motion: That an update be provided in relation to the upgrading of footpaths in Currow. I am getting different answers as to what works are to be done as I have agreed to part fund works in this area.
Reply: At the request of the Currow Tidy Towns Committee, an estimate has been prepared for the upgrade of the footpath on the L3007 by the Duck Pond. The total cost of the works is estimated at €56,750. However, it is proposed to divide the project into 3 phases, Phase 1 – €10,600, Phase 2 – €30,000, Phase 3 – €16,150. This project can be funded via CSMDOF, and will also be considered for funding in the 2018 Footpath Improvement Programme.

Motion: In relation to cycling on footpaths, that we Killarney Municipal District would clearly mark footpaths where cycling is permitted and also where it is not permitted. Furthermore, we should have a bye-law in the town where bells are compulsory on bikes.
Reply: Cyclists cannot currently cycle on footpaths unless there is a cycle lane on it. All cycle lanes are clearly identified. The Municipal District cannot identify legislation under which such a bye-law could be made.

Motion: That we Killarney Municipal District would remove the island in front of the Gaelscoil Faithleann in order to provide more parking for parents trying to park in the area.
Reply: Kerry County Council have contacted the School Management, who are satisfied with the current parking facilities. This island provides natural traffic calming measures as well as being the location of public lights. Kerry County Council would not recommend the removal of this traffic calming measure, however it is the intention of Kerry County Council to propose a new road scheme for this area and parking would be considered as part of this proposal.

Motion: That the Killarney Urban District Council “Prohibition of Consumption of Intoxicating Substances in Public Places Bye-Laws 2000” be enforced. There is a problem with under-age drinking. The Gardaí are working hard but unfortunately it isn’t successful to date as older people are purchasing the alcohol for the under-aged.
Reply: A meeting has been arranged between Municipal District staff and the Gardaí to pursue this matter.

Motion: That Kerry County Council must look at ways to improve all facilities for the homeless where we can. What living facilities do we have in each Municipal District and how many beds are available for the homeless in those Municipal Districts.
Reply: Kerry County Council has 9 beds block booked in a facility in Killarney available for homeless clients. There are also other beds in the same facility (should they be required) for family units which are also wheelchair accessible. In Tralee, there is a 14 bed facility for individuals run by Novas and Kerry County Council has also block booked 8 beds in a privately owned accommodation facility in Tralee for individuals which has a ground floor apartment for family type units with wheelchair accessibility. There are also two other privately owned accommodation facilities in Tralee that Kerry County Council can place clients and families in if the need arises. Kerry County Council has also identified 22 short term transitional properties throughout the County, from the Council Housing Stock which are used to accommodate homeless and vulnerable families.

Reply: All Local Authority Houses in the Killarney Municipal District have been tested for radon gas in the past. We will continue to carry out radon testing in newly acquired properties.

Motion: That we Killarney Municipal District would look at all options on dealing with the homeless.
Reply: People who present as homeless are dealt with through the Homeless Information Centre in Tralee. When people do present to the Centre, all options are explored to ensure that they are provided with suitable accommodation, provided they meet the basic requirements.
In Killarney, at present, we have 9 beds block booked in a facility in Killarney and available for those who present as homeless. Kerry County Council also has other beds, not block booked, available to us in the same facility, should we require same on an emergency basis. These extra beds are mostly used for family type units and are also wheelchair accessible.

Reply: The Killarney Municipal District Office have entered into discussions with the HSE with a view to acquiring a piece of ground in order to improve this junction.

Motion: That we Killarney Municipal District would progress works at the junction at Cathedral Place/Mission Road, reverting it back to two lanes onto New Street.
Reply: Kerry County Council has consulted with the TII in regards to this junction, and while it is agreed that widening of this junction to a two lane approach would reduce the queuing times during busy periods, it is the opinion of the TII that this would compromise Pedestrian Safety at this location and therefore the TII are not in agreement in reverting to a two lane approach.

Motion: That we Killarney Municipal District obtain a written report on flood relief in the Killarney Municipal District area for the past three years, outlining works which have been completed and those which remain outstanding with a completion date for same.
Reply: Outside of the maintenance works (i.e. road drainage, culverting, etc) that have been carried out directly by Killarney MD staff either from own resources or from storm damage allocations, the following are being proposed by the OPW through the National CFRAM project. The OPW South Western CFRAM Study area covers the Killarney MD area. Within this South Western area, potential flood risk measures were developed for Killarney, Glenflesk and Castleisland. These Options went through a series of Public consultation meetings, arranged by the OPW, and preferred options were chosen. These options, along with other similar scheme options for other flood risk areas around the country are at present with the Minister where these scheme will be categorised into Small, Medium and Large, and then prioritised for funding. Once this national prioritisation has been agreed by the Minister, the OPW then intend reverting back to the elected members for consideration/discussion. For Castleisland, a suite of measures including an Impoundment Area at the Anglore Stream, a new Flow Channel at Tullig and Embankments/Walls in the center of the town, are proposed by the OPW. These works are estimated at approx. €5.2m. For Killarney, a series of Flood Embankments/Walls are proposed at various locations including at the Ross Rd. and at the WWTP (Demesne), the southern bank of the Flesk River east of Flesk Bridge (Poulnamuck and Coolclogher), northern bank of Flesk River(Ballycasheen) and at the Caravan Pk (Ballycasheen and Lisavigeen). These works were estimated at approx. €1.3m. For Glenflesk village, a series of embankments were proposed but given the small number of properties they would protect, these were not deemed viable by OPW. (Est > €800,000). A number of properties in the Glenflesk area, have been submitted (with the owner’s consent) to the OPW for consideration under the Voluntary Home Relocation Remedial Works scheme., and at present the only application in the country for funding under this scheme is at Foiladuane, and this is being considered by the OPW. Early indications are that this will be looked on favourably by the OPW. The OPW intend speaking with the other effected property owners, ahead of individual schemes being proposed for their properties. In October 2013, €40,000 funding was allocated for vegetation clearance at the Cullavaw River, Rathmore. This work was carried out in 2014. The Killarney MD Engineer, KCC Flooding Unit Engineer and Biodiversity Officer intend walking the area in the next few weeks. If appropriate and subject to agreement by the OPW, an application for funding will be made to the OPW, with the aim of carrying out the any proposed work in the next available window. (June to Aug 2018) With regards OPW funded Minor Works schemes completed in the Killarney MD area in the last three years, over €200,000 was expended on extensive culverting works at Tulllig, Castleisland (2015 to 2017).

Motion: That we Killarney Municipal District would obtain a costing regarding the proposal as outlined by Mr. David Doyle, Senior Engineer, in respect of the provision of car parking spaces at Loughguittane National School. On Health and Safety we should work together to resolve this serious problem.
Reply: This Loughquittane National School is located on the L3013, a Local Primary Road. Kerry County Council has inspected the location and has submitted it to the Department of Transport Tourist & Sport (DTTS) for a Low Cost Safety Scheme. Motion: That we Killarney Municipal District would write to the HSE or relevant authority questioning why the taxpayer rather than developer must pay the costs for remedial works at Deer Lodge Mental Health Unit after it was found to have radon levels greater than recommended amount.
